Sentenced to Hang
D.M. Toter, of Barbour County, was sentenced to be hanged by the neck until dead on the 18th day of February next, for the murder of his wife, Mrs. Mary Toter, on the 24th day of January last. The jury found his young son, Joseph Toter, guilty of being an accessory before the fact to the murder, and sentenced him to the penitentiary for ten years.
The evidence of the prosecution showed that on the night of the murder, the prisoner and his wife had a quarrel, and that the prisoner struck his wife with a stick, knocking her down. He then went for a gun, and when he returned, he found his wife dead. He then took her body and threw it into a well. The body was found the next morning, and the prisoner was arrested and charged with the murder.
The prisoner's defence was that he was insane at the time of the murder. The jury, however, found him guilty of murder in the first degree.
The sentence of the court will be carried out on the 18th day of February next.
