Petition for Removal from Office
Pocahontas County citizens elected three county commissioners to serve for 6 years. During this time period, the closing of the sanitary landfill has been pending and is now facing certain closing in December 2026. These same county commissioners have neglected their legal obligations to expand the current landfill capacity and/or provide affordable solid waste disposal to the county residents resulting in a potential increase of green box fees to $600 per year, loss of a state mandated free day, and expensive disposal of other solid waste.
They have appointed certain representatives with the operational authority of the solid waste facilities in Pocahontas County who have failed to maintain provide sufficient over site, affordability, accountability, and funding for such operations.
Therefore we, the residents and/or citizens of Pocahontas County, do herein by signed signature, address, and correct date of signing do hereby request of all three county commissioners be removed from office for willful neglect of duty, misfeasance and malfeasance in office. We request that the West Virginia Supreme court appoint a three judge panel to adjudicate our petition for removal of the officials from office and provide other equitable relief as deemed appropriate under the laws of the State of West Virginia.
